Izolare: Vei fi judecător

Before I begin to speak on my arrival here, yet again back to this almighty abandoned place, allow me to shed light on the latest injustices I’ve been driven to endure. Let me tell you had I not been forced to experience many sleepless nights in The Hole (S.H.U.) pondering my next course of action, I doubt I would have held the courage to expose a truth that otherwise may never be known.

Prin urmare, I do believe as a result of this post, some source of aftermath will soon follow. (STAY TUNED IN THE NEAR FUTURE) Note that retaliation can range from extensive mail scrutiny to extended periods of isolation (S.H.U., S.M.U., ADX). Already having served more than 50% of my stint in solitary confinement I find it extremely difficult to believe the remainder of my sentence shall render anything different. With drying tears and a fading hope, I admit that I have little faith in a system that has systematically chosen punishment over rehabilitation. You shall see a list of FACTS that will speak louder and more clearer than I ever could. Vei fi judecător!

2007– transported de la the New Jersey prison system, where I spent consecutive years in isolation (23 & 1) courtesy of the Management Control Unit at New Jersey (Trenton) State Prison, to a federal prison- USP Big Sandy in Inez, Kentucky

2008- escorted to the prison’s Unitatea de carcasă specială.
Infraction: Fighting *200 Series
Sanction: 27 days loss of good time. 30 days Administrative Segregation (AdSeg)

2008/2009– Received my GED from the prison’s education department

2008/2009– Became a prison mentor in the One Way Program

2009– Escorted to the prison’s Special Housing Unit.
Infraction: Possession of homemade intoxicants *200 Series
Sanction: 27 days loss of good time. 30 days Administrative Segregation

2009– Submitted for Special Unitatea de Management a Hearing (S.M.U.). SMU is a “non-punitive” program, 23 și 1 confinement, 18-24 months for completion. SMU was created for inmates deemed not suitable for general population.

2009- Escorted to the prison lieutenant’s office for SMU Hearing. Results to be determined.

2010– Escorted to the prison’s Special Housing Unit
Infraction: Possession of homemade intoxicants *200 series
Sanction: 27 days loss of good time. 30 days Administrative Segregation

2010– SMU referral ACCEPTED!

Inmate Tewhan Butler #26852-050 had been deemed a THREAT to the general population.

Asterisk * Series of Infractions

*300 Series– Minor
*200 Series– Moderate
*100 Series– serious

Note that from 2007-2010 each of the three incident reports I had were 200 Series and moderate offenses. One of the three had been an act of violence (moderate). In the federal penitentiary, a place where chaos rules the day and confusion owns the night, moderate offenses stir little noise and mean even less than you would imagine. With great suddenness my THREE (3) moderate offenses had somehow escalated on the threat chart. That or my central file had been “lined” with “confidential” information from “confidential” sources unbeknown to me. In prison, the right to face your accuser does NU exist. Or I was being sent to a 18-24 month “non-punitive” program for the same offenses that I was in prison for”

Apparently, double jeopardy does not exist in prison either.

2010– Transported to the Special Management Unit at Statele Unite Penitenciarul Lewisburg (Pennsylvania)

2011– Twenty (20) months later, I had successfully completed the SMU and was transported to United States Penitentiary Pollock (Louisiana)

2012– Transferred to a federal penitentiary: USP Beaumont (Texas). The reason, population increase.

2012/2013- I’ve maintained institutional employment, successfully completed an online college course with Lamar University and enrolled in Ashworth College in pursuit of an Associate’s Degree in Psychology. I have not received ONE incident report to date. During this period I have been the subject of THREE (3) different investigations, including the one that has led me back to the SMU. Vă rugăm să fie sfătuiți, the result of each investigation, my innocence was maintained.

NO CHARGE!
NO INFRACTION!
NO SANCTION!
NOT GUILTY!

Not as opinion. Rather FACT. Since my departure from the SMU (NO CHARGES, NO INFRACTIONS, NO SANCTIONS, NOT GUILTY) my behavior in general population has proven to be exceptional. So why, might I ask, have I been once again referred to the SMU (Noiembrie 2013)? In even greater attempt to make sense of nonsense (an impossible feat might I add), here are the latest facts:

Octombrie 19, 2013– a physical altercation occurred involving multiple inmates/prisoners. 19 total. This in many instances would fall under a major disturbance, making involved participants SMU eligible. Not mandatory but discretionary. All individuals were transported to the prison’s SHU and placed under INVESTIGATION until evidence could be gathered to serve proper infractions. Due process allows 30 days for investigations with the right for extension signed only by the prison warden. Prior to the completion of the investigation, eight (8) individuals were released and NO infractions!

Noiembrie 20, 2013- The investigation was complete. Incident reports were administered to eight (8) of the remaining individuals who were being held in the S.H.U. Eight (8) were alleged to have been involved. Three (3) individuals’ investigations rendered unfounded evidence. Three (3) were NU charged and received NO incident report. I WAS ONE. Due process determines staff has 24 hours to serve incident reports. No more than five (5) business days in the event of lockdown or extreme circumstances. Din nou, this only to be determined and signed by the prison warden.

Ianuarie 1, 2014- I remain in the S.H.U. Încă, Am NO incident report, NO infraction, NO sanction. During my stay here in the cold of isolation, I’ve been made aware that, as if a bullseye was carefully attached to my back, I had become a target. Remember consequence? Remember aftermath? Following the investigation, Noiembrie 20, 2013 I had been submitted for a REGULAR transfer to another institution. This referral made by both my unit team and the Administrator of Special Investigations. My being a target would now have to be exposed.

Mysteriously, my regular transfer had been snatched! Like a thief in the night, I had been robbed of my due process and my rights. Justice had been stolen. Even in the midst of this dreadful inequity I was made the bad guy. Remember consequence? Remember aftermath? I had been targeted!

Decembrie 12, 2013– I was referred for the S.M.U. NO incident report. NO infraction. NO sanction. NOT guilty! So why? Vei fi judecător.

În încheiere, notice that this post was written prior to my S.M.U. Hearing and prior to my acceptance. When you are a target the outcome is nonetheless no secret.
