Criminal Justice Reform and the Obama Administration

This blog post is to give a heads up about what is good on the legal front. All prisoners who came to prison after 2008 should NOT listen to those who criticize the Obama Administration for doing NOTHING.

All the jail house lawyers will tell you the biggest difference in law now is that Frelsi laga Information (FOIA) claims filings do not take 12-36 months to be answered. Ennfremur, the most sentencing reform in history has been effected during the tenure of the Obama Administration. Ég veit Families Against Mandatory Minimums (FAMM) tekur a einhver fjöldi af lánsfé fyrir þetta en, til að vera viss, it wasn’t until the Obama Administration was in office that the culture of the judicial and legislative branches began to change. Do not be fooled.

Einnig hvaða fangelsi Húsið lögfræðingur mun segja þér að áður 2008 there was not as many people leaving prison as there are today. This is statistically proven. Lastly, þegar Obama tók við embætti FOIA-umbætur, sentencing reform and prison reform were posted on the White House’s official website as civil objectives on the administration’s to-do list.

Eftir 2008, Við höfum séð mikið af góður í lögum – Peugh, Alleyne, Miller, Riley, Johnson, Descamps, Lafler, og Frye – allar ákvarðanir Hæstaréttar . . . I could go on. Most recently I have written about Montgomery V. Louisiana, a great case that has the opportunity to change how lower courts deal with habeas claims. Lastly, nokkrir bandarískt. District Courts have stood up against prosecutorial misconduct and even filed legal opinions on the epidemic of BRADY violations in today’s justice system.

We even had unprecedented comments from Eric Holder saying we are a society that “yfir-incarcerates” og að hendur út “draconian setningar”. The talk from the Attorney General during the Bush Administration was just the opposite. Í raun, even though the Supreme Court fell one step short of calling today’s drug laws unconstitutional, vegna kynþáttar hlutdrægni, Bush Administration rök enn á móti öllum lækkanir, whereas Eric Holder argued for reductions. Og, Ó já, réttar sönnunargögn hefur breyst. The degree of certainty previously assigned to forensic science has come under great scrutiny since 2008. FAMM og aðrir virðast gleyma þessar staðreyndir, en ég ekki.

Eins og í dag, Forseti Obama hefur mildaðan 240+ sentences and looks to increase that number, ótal og sögulega viðmið. Einnig, there is substantial movement with juvenile justice reform. vísindalega, aldur 25 should be the threshold to distinguish juveniles and adults. There is so much talk that in Connecticut their legislature is investigating whether to raise the legal age for juveniles to 21. Einnig, Alleyne gert McMillan ekki ráðandi, effecting many sentences. Per Montgomery, there is plenty to argue per the 5th Amendment for cases that are final or successive as well as the 6th Amendment for cases that are not final.

The bandarískt. Senate og bandarískt. House of Fulltrúar virðast ætla að standast frumvarp benti á fangelsinu og sentencing umbætur. Þó að ég kann að hafa fram “þetta frumvarp stinks” það er samt allt gott fyrir þá mun það hafa áhrif á. Það er einnig Clemency. There are also a lot of issues to argue per the HOBBS ACT (Samband), RICO, VICAR Section 848, sentencing fyrir hvítum kraga glæpi, og the listi goes á. Before 2008, ekkert af þessum tækifærum verið, og bandarískt. District Courts could have cared less about allowing relief in cases that were final. All this has changed.

Muna, fyrir The Art of Winning rannsókn málaferli Foundation, 85% of prisoners have been convicted of greater offenses than the evidence in their case does supports or have sentences that are meiri en nauðsynlegt er til að ná endum réttvísinnar. The bandarískt. Héraðsdómstólum vilja ekki viðurkenna það, en í dag þeir skilja betur hvernig á að nota aðferðir samkvæmt kafla 2255(F) & (klst).

Að vefja þetta upp, this past week during an oral argument in a case called Welch, Justice Breyer fram að það var “erfitt að trúa” that once the Supreme Court determined that a statute was no longer Constitutional, flestir stefndu slæm fram með lögum, ennþá í fangelsi. Þú segir mér hvað er gott. Annaðhvort það er aftengja milli SCOTUS og neðri dómstólum eða einhver ræðst að halda fólki í fangelsi. Welch var atvinnumaður sjálfu umsækjandi. He filed, Hann kom ekki í veg eða fá kjark. He kept the torch lit and filed a pro se Certiorari to the U.S. Hæstiréttur, after the District Court and the Circuit Court told him he was WRONG! Hann ákvað að ýta á málið! The Solicitor General samþykkir hann er rétt.

Frelsi er þess virði að berjast fyrir!
