Yksinäishuone: When Will it be Unconstitutional?

The road leading to United States Penitentiary Lewisburg.

The road leading to United States Penitentiary Lewisburg.

I did seven months in the Special Management Unit (SMU) in United States Penitentiary Lewisburg before finding out I did not qualify. My custody level is 10. It takes a custody level of 23 to be in a United States Penitentiary. Moreover I have four 300 Series shots [write-ups], which are the equivalent of a speeding ticket in the free world. 4 shots in fifteen years in two of the most violent United States Penitentiaries, and I am serving a LIFE sentence, and I am not going for nothing, takes a lot, and I repeat, a lot, of thinking and luck. So I have been blessed in that regard. I have learned that volatility, true volatility, wears sheep’s clothing.

The SMU is for hard-heads, supposedly non-punitive, but the SMU in United States Penitentiary Lewisburg is FUBAR [fucked up beyond all recognition]. Filthy one man cells with two people in them. 85-percent of the prisoner clearly suffer from mental disorders. Everything is turned da fuck up! That’s the only way to describe the 120-degree days and 100-degree nights. If punitive means punishment, the SMU is more than punitive. It is a place where you do not just dwell, you have to survive. I was there locked down twenty-three hours a day with one free hour outside my cell a day, if lucky, and I was up at 5:30am every morning waiting. For what? You never knew, but I knew something was gonna happen and nine times out of ten it did! In fact when something did not happen, it was not a relief. It was just added anxiety. In the SMU one definitely suffers mentally, physically and emotionally. I can only imagine what prisoners in ADX [Administrative Maximum Florence] go through with no human contact at all.

Toukokuun 22, 2015 in Vienna, the United Nations Commission on Crime Prevention and Criminal Justice unanimously approved the Mandela Rule, which state in part that it is cruel and unusual, per the standards spelled out in our 8th Tarkistus, to confine a person to solitary confinement for more than fifteen consecutive days, unless in exceptional circumstances. And solitary confinement is totally prohibited for prisoners with mental and physical disabilities. The United States supports the Mandela Rules, strongly stating Mandela was “one of the greatest defenders of human rights and dignity in history.” Kuitenkin, it was not until 2008 that Mandela was removed from the terrorist watch list. SMH!

The Standard Minimum Rules (SMRs), which this Mandela Rule falls under has been cited by the United States Supreme Court for a standard minimum of medical care that should be provided (nähdä Estelle v. Gamble, 429 US-. 97, 103 n.8 1976). So although these SMRs are not binding they can and should be used for persuasive argument. Minän December 2014 Miami-Dade County Jails ninth floor was closed down due to several deaths of pre-trial detainees, including the disabled and mentally ill. This County jail was a true American horror story. CBS4 broke the story per a Federal judge Steve Leifman’s prompting. This joint was so FUBAR staff could not call out (dial 911) from the floor. This jail is a couple blocks away from where the Miami Heat play. WTF!

Any one who has done a stint in solitary confinement and in a lockdown facility knows the true meaning of contemplate. Everyone changes when they come to prison. Prison staff included. I was told by a smart and wise man that when you are doing time you have to do weekly self-evaluation. Your goal is to improve or maintain each weak, but that is easier said than done. In the U.S. meillä on 23 & 1 programs that are eighteen months and dudes who have been on 23 & 1 for six-plus years in facilities under Federal jurisdiction. When will it be unconstitutional to do this?

“Anyone who breaks the law should be punished to it its full extent. If they adhere to the rules they wouldn’t have to worry about being subjected to the conditions of prison.” The Constitution is law, and is the law that all other laws come from. The Mandela Rule says at a standard minimum it violates international law to hold someone in solitary confinement for fifteen consecutive days. This law is being broken on a daily basis. This law goes to a person’a basic human rights. Prison proponents say nothing about this law, other than there is no empirical proof solitary confinement adversely affects an inmate’s physical, mental and emotional health. This has been stated under oath to Congress. Wow! And I know dudes doing thirty years for obstruction of justice based on hearsay.

  1. My grandson is in federal prison serving 10 yrs for drugs my heart breaks when I hear he is in the hole for things unknown to his family. I feel prison is a hard thing to handle but I know that if he had not been caught he would have been dead of br robing pharmacies could have been killed or have killed someone. He is being moved to another prison due to something but we don’t know. I love my grandson and want him home.
